SUBJECT: Funding of School Facilities Projects for Under 55% District Aid Percentage Districts
As you are aware, the Educational Facilities Construction and Financing Act, P.L. 2000, c. 72 (the “Act”) authorizes the issuance of bonds in an amount not to exceed $2.5 billion to finance the state share of costs for school facilities projects in districts with a district aid percentage less than 55% (“Under 55% District”). Under the Act, an Under 55% District may elect to have state share for an approved school facilities project determined pursuant to Section 9 or Section 15 of the Act. Section 15 provides for grants by the New Jersey Schools Construction Corporation (“NJSCC”).
The NJSCC has informed the department that the $2.5 billion statutory bond cap may be reached in the near future. It is not clear when or if additional funds beyond the original appropriation will become available as legislative action would be required for additional funding. Therefore, by this letter the department is notifying the Under 55% Districts that they may wish to consider pursuing Section 9 assistance as an alternative for Section 15 grants for funding the state share of the costs of their school facilities projects.
The department advises that any district planning a September 2005 or later referendum may wish to draft the referendum question to include receiving state share either as a Section 15 grant or calculated pursuant to Section 9. You are advised to consult with bond counsel for further guidance in determining how to proceed with referendum questions in light of these developments.
